Confidential Cook County birth injury settlement provides lifelong support for a child who sustained permanent damage to the right arm

CHICAGO, Sept. 29, 2026 /PRNewswire/ — Zayed Law announced today that attorneys Adam J. Zayed and Julian D. Hoshell secured a $3.5 million settlement on behalf of a child who sustained Erb’s palsy during birth.  According to the Jury Verdict Reporter, the confidential settlement ties the Illinois state record for a settlement in this type of case prior to trial.  

The lawsuit alleged that an obstetrician used excessive force and applied excessive lateral traction while addressing the shoulder dystocia during delivery. The newborn suffered a brachial plexus injury that caused permanent deformity, disfigurement, dysfunction, and limited use of the right arm.

The Cook County matter was resolved for $3.5 million, with $2.5 million contributed on behalf of the defendant hospital and $1 million contributed on behalf of the defendant obstetrician.

Erb’s palsy is a form of brachial plexus birth injury that can occur when the network of nerves controlling the shoulder, arm and hand is damaged. The severity and long-term effects vary, but affected children may experience weakness, loss of motion, impaired function, or permanent disability.

Because the settlement is confidential, the identities of the child, family, hospital and obstetrician will not be disclosed.
